About the Aged Care Act (2024)

From 1 November 2025, a new law, the Aged Care Act 2024, came into effect. This new law replaces the old Aged Care Act (1997) and is designed to make aged care safer, fairer, and easier to understand.

What is the New Aged Care Act?

The new law was created after the Royal Commission into Aged Care. It focuses on the rights and needs of older people, not just providers.

The biggest changes are:

  • More rights – respect, safety, and choice in your care
  • Easier access – one simple system to apply for care
  • Better checks on providers – higher standards and stronger rules
  • Clear accountability – providers must give quality care

Strengthened Quality Standards

The existing standards have been replaced by seven stronger standards to ensure care is safe, healthy, and respectful, including food, clinical care, and dementia care.

Statement of Rights

From 1 November 2025, a new Statement of Rights protects you.

It guarantees your right to:

  • Independence and choice
  • Safe and high-quality care
  • Privacy and respect
  • Raise concerns without fear

Whistleblower Protections

Whistleblowers are people who raise concerns about suspected wrongdoing or risks to the safety and quality of aged care. The Aged Care Act 2024 introduced new and explicit protections for people who raise a concern under a whistleblower disclosure in accordance with the Act. Whistleblower reports can be made confidentially and will be taken seriously.
